                                                Procedure for purchasing a Puppy

   To reserve a puppy, we require a $300 nonrefundable deposit by cash or credit card.   By placing a deposit, you are agreeing to the terms of the  contract Listed Below. 

    Please contact Susan by call or text at 315 651 8298 to find out availability of puppies. I wait till puppies are 5 weeks of age before allowing reserves.

 herein referred to as buyer(s). In consideration of payment in full of the purchase price of $____________ by buyer(S) to seller, Seller agrees to transfer to buyer(s) , subject to terms and conditions in this contract , the ownership of one  Labrador Retriever Puppy , herein referred to as puppy regardless of age from the mating of sire and dam identified below

 If buyer does not ask for full/open registration, it will be marked Limited for pet only. Full registration will be a $200 additional Fee.

 1. Deposit, payment of Purchase Price and fees:

. * Buyer acknowledges and agrees that buyer will forfeit the deposit and any rights to the dog

 a) buyer fails to complete the purchase of the dog for any reason

 (b) buyer fails to pay the balance of the purchase price within 7 days of the agreed delivery date.

 Upon these terms, the deposit is nonrefundable and in either event, seller is free to sell the dog to another party

 • If the dog is not available due to sickness, death, or other circumstances owing to the fault of the seller, buyers deposit will be fully refunded.

 2. OUR HEALTH GUARANTEE And WARRANTIES  This agreement is for the benefit of both the buyer and seller

The breeder guarantees that your puppy will be current on all vaccines and deworming medication. (According to age) as stated on puppy's health record. We recommend that you take the puppy to your veterinarian (at your cost) after you receive your puppy. All puppies will have had a physical health exam from my veterinarian and deemed healthy prior to leaving my home. (Unless discussed or stated otherwise.)

 If, within fourteen business days following the pickup of puppy, a veterinarian of the consumer's choosing, licensed by a state certifies such animal to be unfit for purchase due to illness or the presence of symptoms of a contagious or infectious disease,

   or if, within one hundred eighty calendar days following a pick up,  a licensed veterinarian certifies such animal to be unfit for purchase due to a congenital malformation which adversely affects the health of the animal, the pet dealer shall afford the consumer the right to choose one of the following options:

 ♦ The right to return the animal and receive a refund of the purchase price including sales tax and reasonable veterinary costs directly related to the veterinarian’s certification that the animal is unfit for purchase; or

 ♦ The right to return the animal and to receive an exchange animal of the consumer’s choice of equivalent value and reasonable veterinary costs directly related to the veterinarian’s certification that the animal is unfit for purchase; or

♦ The right to retain the animal and to receive reimbursement from a pet dealer for veterinary services from a licensed veterinarian of the consumer’s choosing, for the purpose of curing or attempting to cure the animal. The reasonable value of reimbursable services rendered to cure or attempting to cure the animal shall not exceed the purchase price of the animal. The value of such services is reasonable if comparable to the value of similar services rendered by other licensed veterinarians in proximity to treating veterinarians. Such reimbursement shall not include the costs of initial veterinary examination, fees and diagnostic fees not directly related to the veterinarian’s certification that the animal is unfit for purchase

Any refund and/or reimbursement required shall be made by seller not later than ten business days following receipt of a signed veterinary certificate as herein required. Such certification shall be presented to the pet dealer not later than three business days following receipt thereof by the consumer. A form for the certification that an animal is unfit for purchase which shall be provided to a consumer by an examining veterinarian upon the examination of a puppy. That form includes information which identifies the type of animal, the owner, the date and diagnosis of the animal, the treatment recommended, if any, and an estimate of the actual cost of such treatment. Such form also includes this notice.

 A veterinary finding of intestinal parasites shall not be grounds for declaring the dog or cat unfit for sale unless the animal is clinically ill due to such condition. An animal may not be found unfit for sale on account of an injury sustained or illness contracted subsequent to the consumer taking possession thereof. Breeder does not guarantee size, color, temperament, or shedding factor.

 3. GUARANTEE RELATING Hip and Elbow Dystocia

 A warranty against severe hip or elbow dysplasia (DISPLACIA SO EXTREME THAT IT PREVENTS THE DOG FROM BEING A FUNCTIONAL FAMILY COMPANION AND THAT SURGERY OR EUTHANASIA IS INDICATED) provided the x-rays are examined by OFA. This warranty is provided to the original purchaser for up to 24 months of age

 Should this puppy/dog is found to have Severe genetic hip or elbow dysphasia within the first 24 months of its life. Buyer must provide seller with proof of diagnosis, with all documentation on the condition, such as vet records, x-rays, or any other necessary paperwork. For hip or elbow dysphasia x-rays must be examined by OFA. All information must be sent to the breeder within 1 week of diagnosis by a licensed veterinarian before a replacement puppy or refund is issued.

No replacement puppy or refund will be given if:

• If puppy/dog is euthanized without seller’s permission.

 • If this dog is allowed to get overweight at any time, or developing joints to be overstressed at any point during this warranty period.

 • Any physical problems which are or could be the result of injury are not covered by this warranty

. • Is not eating a high-quality dog food for the first 2 years of its life.

 Buyer has the option to choose 1 of the 2 replacement options below.

 Breeder will either:

1. Replace the dog, with a puppy of equal value (free of charge) when available. Shipping or delivery fees are the responsibility of the buyer.

 2. If buyer does not want a replacement puppy. Breeder will reimburse the buyer once, up to, but no more than 50% of the purchase price paid for the puppy, to help offset some of the veterinarian or medical treatment expenses. Vet bills will have to be sent to the breeder before any refund will be given.

 Please know that we usually will not ask you to return your beloved companion in order for this warranty to be valid. But there may be exceptions. We feel it would not be fair for dog/puppy to leave the security of its family and home, that it has grown to love so much, or vice versa.

This health agreement is only applicable to the original purchaser. If the dog is sold or rehomed this warranty/contract is cancelled
